Terms of Service

Nox is an ambient sound mixer and sleep/focus companion app, available free with an optional one-time in-app purchase (“Nox Premium”) that unlocks additional features described in the app.

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Nox on devices you own or control, for your own personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from the app, its source code, its sound library, or its branding, except to the extent expressly permitted by applicable law.

Nox does not require you to create an account to use it. There is nothing to register and nothing for us to suspend or terminate on our end beyond your local installation of the app.

“Nox Premium” is a one-time, non-consumable purchase that unlocks additional features for as long as the app remains installed on a device signed into the Apple ID / Google account that made the purchase (or any device where you use “Restore Purchases” with that same account). The price is set and displayed by the Apple App Store or Google Play at the time of purchase, in your local currency where applicable.

All payments are processed exclusively by Apple or Google. We do not process payments ourselves, do not store your payment information, and cannot directly issue refunds. Refund requests must be submitted through Apple’s or Google’s own refund process:

You agree not to: use Nox for any unlawful purpose; attempt to disrupt, reverse-engineer, or interfere with the app’s normal operation; misrepresent the app’s sound library or branding as your own; or use the app in any way that violates the terms of the app store through which you downloaded it (Apple App Store or Google Play).

Nox, including its name, logo, visual design, and the specific sound recordings bundled with the app, is owned by or licensed to EC Mobile. Nothing in these Terms transfers any ownership of that intellectual property to you — you receive only the personal-use license described in Section 2.

Nox is an ambient sound and relaxation tool intended for general wellbeing purposes only. Any tonal or frequency-based sounds included in the app (for example, “Alpha Focus” or “432Hz”) are offered purely as ambience or focus aids, without any therapeutic, medical, or curative claim. If you have a medical condition, including a sleep disorder, please consult a qualified healthcare professional — do not rely on Nox as a substitute for medical advice or treatment.

Nox is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that any particular sound, feature, or timer behavior will meet your expectations.

To the maximum extent permitted by applicable law, EC Mobile shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, Nox, even if advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, including any mandatory consumer-protection rights you may have in your country of residence.

We may discontinue or modify Nox, in whole or in part, at any time. You may stop using Nox at any time by uninstalling it from your device. Sections of these Terms that by their nature should survive termination (including Sections 6 through 9) will continue to apply.

We may update these Terms as the app evolves. Changes will be reflected in an updated “Last updated” date at the top of this page and, for material changes, an in-app notice. Continuing to use Nox after a change becomes effective means you accept the revised Terms.

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law principles, and any dispute arising from these Terms or your use of Nox shall be subject to the exclusive jurisdiction of the courts of Türkiye — except where this would deprive you of any mandatory consumer-protection rights available to you under the law of your own country of residence, which remain unaffected by this clause.
